Special Procedure

In an undefended divorce, the decree can be issued without either petitioner or respondent having to appear (or be represented) at the court; the District Judge considers the facts submitted by the petitioner in the petition and verified on affidavit. When he or she is satisfied that the facts in the petition are proved and that the grounds for divorce exist, he or she will issue a certificate to that effect and fixed a date for the formal pronouncement of the decree nisi by the Judge. A copy of the decree is sent through the post both husband and wife by the court office.
